Just reviewed a baffling case out of the Dallas Court of Appeals were the court ruled that the officer had probable cause to arrest a client for Driving While Intoxicated, despite the officer’s admissions that the smell of alcohol on client’s breath did not necessarily indicate intoxication and that client’s bloodshot eyes could have been caused by vehicle’s air bag deployment.
