Administrative License Revocation Program (“ALR”) Issues

There are only four issues at an ALR hearing:

1. officers had reasonable suspicion or probable cause to make the stop;

2. officers had probable cause to believe the person was driving a motor vehicle or operating a watercraft in a public place while intoxicated;

3. the person was placed under arrest by the officer and was asked to give a blood or breath specimen; and

3. the person refused to give a specimen.

Tex. Trans. Code sec. 724.042

If the administrative judge finds in the affirmative on all four issues, the driver’s license will be suspended. Tex. Trans. Code sec 724.043
