A STORE RECIEPT IS NOT “OTHER COMERCIAL INSTURMENT” FOR TEXAS FORGERY STATUTE

Shipp v. State; PD-1346-09 gives the Texas Court of Criminal Appeals the ability to decide if a store receipt can be considred an “other comercial insturment” under 32.21(d). The lower court decided that the store reciept was a “writing” (i.e. misdemenor) and not a “commercial instrument” (i.e. felony).
